EPR Target Fulfilment for Tyre Waste:

Extended Producer Responsibility (EPR) is a regulatory framework that places the responsibility on tyre producers to manage end-of-life tyres in an environmentally sustainable manner. The Hazardous and Other Wastes Amendment Rules, 2022, introduced by the Ministry of Environment, Forest, and Climate Change, define the EPR targets and obligations for tyre waste management. The fulfilment of EPR targets involves specific responsibilities for producers, importers, and brand owners dealing with tyre manufacturing and sales.

Key Entities and Responsibilities:

Producers (Manufacturers or Importers) of New Tyres:
Year 2022-2023:
EPR obligation is 35% of the quantity of new tyres manufactured or imported in 2020-2021.

Year 2023-2024:
EPR obligation is 70% of the weight of tyres manufactured or imported in 2021-2022.

Year 2024-2025:
EPR obligation is 100% of the weight of new tyres manufactured or imported in 2022-2023.

After 2024-2025:
EPR obligation is 100% of the weight of new tyres manufactured or imported in the year (Y-2).

Units established after April 1, 2022:
Deferred EPR obligation starts after two years and is 100% of the weight of new tyres manufactured or imported in the year (Y-2).

Importers of Waste Tyres:
EPR obligation is 100% of the tyres imported in the preceding year (Y-1).

Retreading Entities: EPR obligation for retreaded tyres is deferred for one year.

Producer Responsibility under EPR for Tyre Waste:

The term "producer" includes entities involved in manufacturing, selling new tyres, selling domestically under their brand, selling imported new tyres, importing vehicles with new tyres, or importing waste tyres. Producers must fulfil their EPR obligation by purchasing EPR certificates from registered recyclers and submitting them on the CPCB portal through quarterly returns. Producers need to provide details about the composition of tyres, including average weight, materials used, and other relevant information.

Recycler's Responsibility under EPR for Tyre Waste: A recycler is responsible for converting waste tyres into environmentally friendly end products like reclaimed rubber, crumb rubber, modified bitumen, and pyrolysis oil/char. Recyclers play a crucial role in the tyre waste management chain, ensuring proper disposal and recycling in compliance with environmental regulations.

Retreader's Responsibility under EPR for Tyre Waste: Retreading of waste tyres is allowed, and retreaders must register on the CPCB portal to issue retreading certificates. The EPR obligation for retreaders is deferred by one year (until 2023), provided that the obligation is fulfilled after end-of-life disposal through a registered recycler.

Procedure for EPR Registration for Tyre Waste:

Submit an application form on the CPCB portal to obtain login credentials. Log in using the credentials and fill out the online registration form with necessary details, including activity details and the proposed EPR plan.
Attach required documents, such as proof of ownership, proposed EPR plan details, and relevant information. Submit the online application form with necessary documents within the stipulated 30 days. CPCB reviews the application, provides a registration number within 15 days if approved.
The authorised person must comply with EPR regulations, submit regular reports on waste tyre management activities.
If approved, the applicant receives a two-year EPR authorization certificate.

Transaction of Extended Producer Responsibility Certificates:
Producers can purchase EPR certificates limited to their liability for the current year plus any leftover liability from preceding years plus 10% of the current year's liability.
The obligation can be fulfilled by proportionately purchasing EPR certificates quarterly.
Availability, requirement, and other details are updated regularly on the CPCB portal.

Provision for Post-Compliance and Inspection:
CPCB has the authority to verify compliance through inspection and periodic audit.
Penalties are imposed for violations or non-fulfilment of extended producer responsibility targets.

Penalties for Non-Compliance:
Entities providing false information or violating provisions may face prosecution and penalties in the form of environmental compensation.
Unregistered entities aiding violators can also face penalties.
Compensation payment does not absolve entities from EPR obligations; shortfalls are carried forward for up to three years.

Refund Criteria for Environmental Compensation:
Refund percentages vary based on the year in which the shortfall is covered.
Refund percentages range from 85% in the first year of penalty to no refund after the third year.
