A brief description of the Pollution NOC issued by the State Pollution Control Board (SPCB).
In order to operate or establish an industrial plant or any project, it is mandatory to obtain Consent to Operate (CTO) from the State Pollution Control Board. To establish an outlet, compliance with the provisions specified under Section 25 of the Water (Prevention and Control of Pollution) Act, 1974 is required. Similarly, to operate an industrial plant, adherence to the rules mentioned under Section 21 of the Air (Prevention and Control of Pollution) Act, 1981 is necessary.

Consent to Establish:
This is the form of Consent required by the Authority to set up or run any manufacturing industry. It is considered the primary authority to set up any industry that may cause air, water, or noise pollution.
Consent to Operate:
This type of Consent is required to ensure that the industry maintains the standards related to its operations. All industries need to obtain this Consent to operate.
What are the eligibility criteria required to obtain NOC?
Following are the eligibility criteria to obtain NOC by an individual from SPCB:
- Demarcated areas for Industries.
- The Industries should not have Rs. 1 crore plant and machinery.
- Industries which do not have Rs. 2 crores of machinery on hosiery units.
- Industry should not discharge any form of pollution.
- No toxic and hazardous waste should be discharged from the industry.
Any individual can apply for the NOC while complying with the above requirements to get the same from the state pollution control board.
List of Required Documents for Obtaining NOC from State Pollution Control Board
The following documents are required to obtain NOC:
- Effluent sewage treatment and emissions sources should be included in the layout plan of the industry or manufacturer along with other design details.
- Providing information on the capacity of the DG set is also a requirement.
- A process flow sheet displays information about the process flow.
- A report on the analysis of solid waste, effluent, hazardous wastes, and fuel gases is required.
- Information regarding the equipment employed by the water pollution control board and the air pollution control board is required.
- Report on the quality of air effluents.
- A fee is applicable for obtaining Consent, and it can be paid through a demand draft made out in favor of the relevant pollution control authority.
- Planning and budgeting for water calculations
- The monitoring facility is depicted in a diagrammatic format.
- Reports analyzing the emissions are referred to as Emission Analysis Reports.

Steps to Acquire NOC from State Pollution Control Board
- The process of acquiring NOC from the state pollution control board can be initiated through the online consent management and monitoring system.
- To operate a manufacturing industry in compliance with environmental laws, the proprietor must obtain Consent to Operate (CTO). This requires submitting the relevant permits, fees, and the CTO form to obtain the license.
- Prior to starting any activities, the applicant must obtain a NOC from the State Pollution Control Board. Even for trial production, it is necessary to obtain Consent to Operate.
- An inspection of the industrial unit will be conducted by an officer before granting the NOC.
- The Competent Authority will verify the adequacy of pollution control measures/devices implemented during the acquisition of Consent to Establish (CTE) as well as their structural soundness before granting the initial Consent to Operate (CTO) under the Water Act, 1974/Air Act, 1981, and authorization under the Hazardous Waste Management Rules.
- After issuing the initial CTO, the industry will be inspected again after three months to ensure compliance with the Air and Water Pollution regulations.
- If the industry has followed the sample tests, the license will not be revoked.
- If the industry fails to comply, the license will be revoked and terminated.
- The validity period for a Consent to Operate (CTO) under the Water Act of 1974 & the Air Act of 1981 is as follows:
- Red category industries have a validity period of 5 years for their Consent to Operate (CTO) under the Water Act of 1974 and the Air Act of 1981.
- On the other hand, Orange category industries have a validity period of 10 years for their CTO.
