A brief description of the Pollution NOC issued by the State Pollution Control Board (SPCB).

In order to operate or establish an industrial plant or any project, it is mandatory to obtain Consent to Operate (CTO) from the State Pollution Control Board. To establish an outlet, compliance with the provisions specified under Section 25 of the Water (Prevention and Control of Pollution) Act, 1974 is required. Similarly, to operate an industrial plant, adherence to the rules mentioned under Section 21 of the Air (Prevention and Control of Pollution) Act, 1981 is necessary.

Consent to Establish:

This is the form of Consent required by the Authority to set up or run any manufacturing industry. It is considered the primary authority to set up any industry that may cause air, water, or noise pollution.

Consent to Operate:

This type of Consent is required to ensure that the industry maintains the standards related to its operations. All industries need to obtain this Consent to operate.

Steps to Acquire NOC from State Pollution Control Board

  1. Red category industries have a validity period of 5 years for their Consent to Operate (CTO) under the Water Act of 1974 and the Air Act of 1981.
  2. On the other hand, Orange category industries have a validity period of 10 years for their CTO.
