Batteries (Management and Handling) Rules 2001: These rules outline the government's plan for efficient battery management and handling to minimise environmental threats. Rule 5 delegates the responsibility of providing registration to importers to the Central Pollution Control Board (CPCB).

Hazardous Waste Management Rules: These rules ensure the secure handling, generation, treatment, import, packaging, processing, storage, transportation, re-processing, collection, conversion, sale, destruction, and disposal of hazardous waste. State Pollution Control Boards/ Pollution Control Committees play a crucial role in managing hazardous waste.

Procedure for Obtaining Registration for Scrap Battery Import

Importing scrap batteries involves complying with regulations set by the State Pollution Control Board (SPCB) in India. Below is an overview of the procedure for obtaining registration for scrap battery import:

Recycler's License: A recycler intending to import scrap batteries should already hold a license from the State Pollution Control Board (SPCB) for recycling such materials.

Application to SPCB: The recycler must apply to the respective State Pollution Control Board in advance. The application should include details about the planned import, and it must be submitted along with the necessary supporting documents.

Forwarding Application by SPCB: Upon receiving the application, the State Pollution Control Board will review it and forward the application with recommendations and stipulations for safe transport and processing within 30 days.

State Government's NOC: The state government will issue a No Objection Certificate (NOC) for import if the recycler provides a valid informed consent letter along with an authenticated copy from the exporting country's concerned authority.

Certification by MOEF/SPCB: An actual user, such as a recycler or trader, is eligible for certification by the Ministry of Environment, Forest and Climate Change (MOEF) or the State Pollution Control Board. This certification serves as the basis for importing scrap batteries into India.

Scrap Battery Import - Compliances

Record Maintenance: The importer of battery scrap should maintain a record of the imported wastes in Form-3. This record should be made available whenever required.

Annual Return Filing: The importer is required to file an annual return in Form-4 to the State Pollution Control Board (SPCB). This annual return provides details about the quantity and nature of the imported scrap batteries.
